TRAI guidelines to regulate unsolicited commercial Calls and messages

To regulate unsolicited commercial call and messages TRAI has notified "The Telecom Commercial Communication Customer Preference Regulations, 2010" which came into force from 27th September, 2011.
Under this regulation Customers (landline and mobile) who do not want to receive commercial communications can dial or SMS to 1909 (toll free) and register in either of the two categories:

1) Fully Blocked Category- stoppage of all commercial Calls/SMS .For this one has to write "START 0" and send it to 1909
2) Partially Blocked Category- stoppage of all commercial Calls/SMS except SMS from one of the opted preferences. For this one has to send SMS 'START' with one or multiple options from the list of seven categories.

There are at present 7 preferences to choose from- 
1)Banking/Insurance/Financial Products/Credit Cards, 
2) Real Estate,
3) Education, 
4) Health, 
5) Consumer goods and automobiles, 
6) Communication/Broadcasting/Entertainment/IT,
7)  Tourism.

For example: To receive messages relating to only Health products, then send SMS "START 4" to 1909. Similarly, for receiving messages relating to Real Estate and Education, send SMS "START 2,3" to 1909.

On successful registration an SMS confirming exercised options and a Unique Registration Number within 24 hrs. The registration will be effective within 7 days of placing the request with the service provider. 

Furthur all commercial calls will come from number starting with 140 and only between 9am to 9pm. Also, in order to control the possibility of SMS packages (those allow a very large number of SMS per day) to be used by the telemarketers for sending large number of SMSs from a normal telephone number, a limit of 100 SMS per day per SIM has been laid down under these regulations except on blackout days. 

For the convenience of subscribers, the TRAI has made it mandatory for all operators to set up a facility for registration of complaints of customers regarding receipt of unsolicited commercial calls either through voice calls or SMS, which will be toll free. The new regulations have provisions of hefty penalty of up to Rs.2.50 lakh on erring telemarketing companies and blacklisting of habitual offenders.

    was it neccessary to put limitations on sms packages?
    It was good to restrict unsolicited calls or texts..

    Limitations on sms package is widely debated...i think govt should make a way out to allow normal consumers to use unlimited sms package

मोची

मुंबई स्थित मलाड स्टेशन के बाहर बैठने वाला एक मोची मेरे लिए पिछले 4 महीनों से कौतूहल का विषय बना हुआ था। 4 माह पूर्व मैंने मलाड स्थित एक कंपनी में नौकरी ज्वाइन की थी, यद्यपि मेरी पिछली नौकरी की तुलना में वेतन यहां कुछ कम था परंतु महत्वपूर्ण बात यह थी कि यह मेरे निवास स्थान बोरीवली से बहुत ही नज़दीक था जिसकी वजह से मुझे सुबह एवं शाम दोनों वक्त स्वयं के लिए समय मिल जाता था। मेरी अन्य आदतों में एक बहुत ही गैर जरूरी आदत यह रही है कि मैं रोज ऑफिस जाने से पहले अपने जूते मोची से पॉलिश करा कर जाता रहा हूं। ऑफिस का वक्त 9:30 बजे प्रारंभ होता था और मैं सामान्यता 9:15 बजे मलाड स्टेशन पर उतर कर अपने जूते पॉलिश कराने के पश्चात 9:25 बजे तक ऑफिस पहुंच जाया करता था। नई नौकरी ज्वाइन किए हुए करीब 1 हफ्ते का वक्त गुजरा होगा मैं रोज की तरह स्टेशन से उतर कर जिस जगह कतार में 5-6 मोची बैठे रहते थे उस और अपने जूते पॉलिश कराने के उद्देश्य से गया। आज मैं समय से थोड़ा पहले निकला था, वक्त करीब 9:00 बज रहे थे मैंने देखा की बाकी सभी मोची व्यस्त थे एवं एक थोड़ा अलग सा दिखने वाला मोची अभी अभी तुरंत ही आया था। उसे ख...

Guidelines for Lie Detection / Narco analysis / Polygraphy etc Test

Supreme Court in Smt Selvi & Ors vs State of Karnataka (Criminal Appeal No. 1267 of 2004) on 5th May 2010 held that:  No individual should be forcibly subjected to any of the techniques in question, whether in the context of investigation in criminal cases or otherwise. Doing so would amount to an unwarranted intrusion into personal liberty. However, the court allowed voluntary administration of the impugned techniques in the context of criminal justice, provided that certain safeguards are in place. Even when the subject has given consent to undergo any of these tests, the test results by themselves cannot be admitted as evidence because the subject does not exercise conscious control over the responses during the administration of the test. However, any information or material that is subsequently discovered with the help of voluntary administered test results can be admitted, in accordance with Section 27 of the Evidence Act, 1872.
